Nelson Hurst and affiliates (“NelsonHurst”, “us”, “our” or “we”) are dedicated to protecting the privacy rights of our users (“users” or “you”). This Privacy Policy (the “Policy”) describes the ways we collect, store, use, and manage the information, including personal information, that you provide or we collect in connection with our websites, including www.nelsonhurst.com (the “Sites”) or any NelsonHurst game provided on a desktop or mobile platform (for example, iOS and Android)(collectively, the “Service”). Please note that the scope of this Policy is limited to information collected or received by NelsonHurst through your use of the Service. NelsonHurst is not responsible for the actions of third-party people or companies, the content of their sites, the use of information you provide to them, or any products or services they may offer. Any link to those sites does not constitute our sponsorship of, or affiliation with, those people or companies.
By using the Service, you are expressing your agreement to this Policy and the processing of your data, including your personal information, in the manner provided in this Policy. If you disagree with these terms, please do not use the Service.
Information Collection and Use
NelsonHurst collects information as described below. NelsonHurst’s primary goals in collecting and using information are to create your account, provide Services to you, improve our Service, contact you, conduct research, and create reports for internal use.
In order to use your community forum/blog, you must have a name and a valid email address.
NelsonHurst’s Sites
While you are browsing NelsonHurst’s Sites, your computer’s operating system, Internet Protocol (IP) address, access times, browser type, and language and referring Web site addresses may be logged automatically. We may use this information to monitor, develop and analyze your use of the Service. In addition, we may ask you to submit and we may process data that is personal to you, including but not limited to your name, profile photo, gender, age or birthday, links to your profiles on social networking websites and other third party sites, user names and email and mail addresses. We may use this information to create a user profile and provide you with services. We may use your email address to contact you about your experience with NelsonHurst Sites and notify you about company news and promotions. Your gender and birthday may be used to analyze user trends and target certain promotions. Your mail address may be used if we have merchandise or other physical promotional materials that we want to send to you.
Activity Log
This feature only records the activities of a site’s registered users, and the retention duration of activity data will depend on the Site’s plan and activity type.
Data Used: To deliver this functionality and record activities around site management, the following information is captured: user email address, user role, user login, user display name, WordPress.com, and local user IDs, the activity to be recorded, the WordPress.com-connected site ID of the Site on which the activity takes place, the Site’s Jetpack version, and the timestamp of the activity. Some activities may also include the actor’s IP address (login attempts, for example) and user agent.
Activity Tracked: Login attempts/actions, post and page update and publish actions, comment/pingback submission and management actions, plugin and theme management actions, widget updates, user management actions, and the modification of other various site settings and options. Retention duration of activity data depends on the Site’s plan and activity type. See the complete list of currently-recorded activities (along with retention information).
Data Synced: Successful and failed login attempts, including the actor’s IP address and user agent.
Contact Form
Data Used: If Akismet is enabled on the site, the contact form submission data — IP address, user agent, name, email address, website, and message — is submitted to the Akismet Service (also owned by Automattic) for the sole purpose of spam checking. The actual submission data is stored in the database of the Site on which it was submitted and is emailed directly to the owner of the form (i.e. the site author who published the page on which the contact form resides). This email will include the submitter’s IP address, timestamp, name, email address, website, and message.
Data Synced: Post and post metadata associated with a user’s contact form submission. If Akismet is enabled on the Site, the IP address and user agent originally submitted with the comment are synced, as well, as they are stored in post meta.
Google Analytics
Data Used: Please refer to the appropriate Google Analytics documentation for the specific type of data it collects. For sites running WooCommerce (also owned by Automattic) and this feature simultaneously and having all purchase tracking explicitly enabled, purchase events will send Google Analytics the following information: order number, product id and name, product category, total cost, and quantity of items purchased. Google Analytics does offer IP anonymization, which can be enabled by the site owner.
Activity Tracked: This feature sends page view events (and potentially video play events) over to Google Analytics for consumption. For sites running WooCommerce-powered stores, some additional events are also sent to Google Analytics: shopping cart additions and removals, product listing views and clicks, product detail views, and purchases. Tracking for each specific WooCommerce event needs to be enabled by the site owner.
Gravatar Hovercards
Data Used: This feature will send a hash of the User’s email address (if logged in to the Site or WordPress.com — or if they submitted a comment on the Site using their email address that is attached to an active Gravatar profile) to the Gravatar service (also owned by Automattic) in order to retrieve their profile image.
Infinite Scroll
Data Used: In order to record page views via WordPress.com Stats (which must be enabled for page view tracking here to work) with additional loads, the following information is used: IP address, WordPress.com user ID (if logged in), WordPress.com username (if logged in), user agent, visiting URL, referring URL, timestamp of event, browser language, country code.
Activity Tracked: Page views will be tracked with each additional load (i.e. when you scroll down to the bottom of the page and a new set of posts loads automatically). If the site owner has enabled Google Analytics to work with this feature, a page view event will also be sent to the appropriate Google Analytics account with each additional load.
Jetpack Comments
Data Used: Commenter’s name, email address, site URL (if provided via the comment form), timestamp, and IP address. Additionally, a jetpack.wordpress.com IFrame receives the following data: WordPress.com blog ID attached to the Site, the ID of the post on which the comment is being submitted, commenter’s local user ID (if available), commenter’s local username (if available), commenter’s site URL (if available), the MD5 hash of the commenter’s email address (if available), and the comment content. If Akismet (also owned by Automattic) is enabled on the Site, the following information is sent to the Service for the sole purpose of spam checking: commenter’s name, email address, site URL, IP address, and user agent.
Activity Tracked: The comment author’s name, email address, and site URL (if provided during the comment submission) are stored in cookies. Learn more about these cookies.
Data Synced: All data and metadata (see above) associated with comments. This includes the comment’s status and if Akismet is enabled on the Site, whether or not it was classified as spam by Akismet.
Mobile Theme
Data Used: A visitor’s preference on viewing the mobile version of a site.
Activity Tracked: A cookie (akm_mobile) is stored for 3.5 days to remember whether or not a visitor of the Site wishes to view its mobile version.
Protect
Data Used: To check login activity and potentially block fraudulent attempts, the following information is used: attempting User’s IP address, attempting User’s email address/username (i.e., according to the value they were attempting to use during the login process), and all IP-related HTTP headers attached to the attempting User.
Activity Tracked: Failed login attempts (including IP address and user agent). We also set a cookie (jpp_math_pass) for one day to remember if/when a user has completed a math captcha to prove that they’re an actual human. Learn more about this cookie.
Data Synced: Failed login attempts, which contain the User’s IP address, attempted username or email address, and user agent information.
Search
Data Used: Any of the visitor-chosen search filters and query data in order to process a search request on the WordPress.com servers.
Sharing
Data Used: When sharing content via email (this option is only available if Akismet is active on the Site), the following information is used: sharing party’s name and email address (if the User is logged in, this information will be pulled directly from their account), IP address (for spam checking), user agent (for spam checking), and email body/content. This content will be sent to Akismet (also owned by Automattic) to perform a spam check. Additionally, if reCAPTCHA (by Google) is enabled by the site owner, the sharing party’s IP address will be shared with that Service. You can find Google’s privacy policy here.
WordPress.com Stats
Data Used: IP address, WordPress.com user ID (if logged in), WordPress.com username (if logged in), user agent, visiting URL, referring URL, timestamp of event, browser language, country code. Important: The site owner does not have access to any of this information via this feature. For example, a site owner can see that a specific post has 285 views, but he/she cannot see which specific users/accounts viewed that post. Stats logs — containing visitor IP addresses and WordPress.com usernames (if available) — are retained by Automattic for 28 days and are used for the sole purpose of powering this feature.
Activity Tracked: Post and page views, video plays (if WordPress.com hosts videos), outbound link clicks, referring URLs, and search engine terms and country. Jetpack also tracks performance on each page load that includes the Javascript file used for tracking stats when this module is enabled. This is exclusively for aggregate performance tracking across Jetpack sites to ensure that our plugin and code is not causing performance issues. This includes tracking page load times and resource loading duration (image files, Javascript files, CSS files, etc.). The site owner can force this feature to honor the DNT settings of visitors. By default, DNT is currently not honored.
YouTube
Our website uses plugins from YouTube, which Google operates. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.
If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about the pages you have visited.
If you’re logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your profile. You can prevent this by logging out of your YouTube account.
YouTube is used to help make our website appealing. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.

Vimeo
Our website uses features provided by the Vimeo video portal. This Service is provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.
If you visit one of our pages featuring a Vimeo plugin, a connection to the Vimeo servers is established. Here the Vimeo server is informed about which of our pages you have visited. In addition, Vimeo will receive your IP address. This also applies if you are not logged in to Vimeo when you visit our plugin or do not have a Vimeo account. The information is transmitted to a Vimeo server in the US, where it is stored.
If you are logged in to your Vimeo account, Vimeo allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your Vimeo account.

Google Web Fonts
For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
For this purpose, your browser has to establish a direct connection to Google servers. Google thus becomes aware that our web page was accessed via your IP address. The use of Google Web fonts is done in the interest of a uniform and attractive presentation of our plugin. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.
If your browser does not support web fonts, a standard font is used by your computer.

Akismet
We collect information about visitors who comment on Sites that use our Akismet anti-spam Service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).
Social Media (Features) and Widgets
Our Web site includes Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our Site. These Features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.
iOS and Android Platforms
When you use any of the NelsonHurst games or applications on a mobile platform, we may collect and record certain information such as your unique device ID (persistent / non-persistent), hardware type, media access control (“MAC”) address, international mobile equipment identity (“IMEI”), the version of your operating system (“OS”), your device name, your email address (if you have connected to Facebook or Google+), and your location (based on your Internet Protocol (“IP”) address). This information is useful to us for troubleshooting and helps us understand usage trends.
We may collect your location-based information for the purpose of providing you with the correct version of the application. We will not share this information with any third party. If you no longer wish to allow us to track or use this information, you may turn it off at the device level. Please note that the application may not work properly if we cannot tell where you are coming from (Country specific).
In addition, we create a unique user ID to track your use of our Service. This unique user ID is stored in connection with your profile information to track the NelsonHurst games you are playing.
Facebook Connect, Game Center and Google+
You can log in to our Site using sign-in services (“SN Service”) such as Facebook Connect, Apple’s Game Center, or an Open ID provider. These services will authenticate your identity and provide you the option to share certain personal information with us, such as your name, email address, and resume, to pre-populate our sign-up form. In addition, services like Facebook Connect give you the option to post information about your activities on this Web site to your profile page to share with others within your network.
We may collect and record information through the SN Service in accordance with the policies and terms of that SN Service. The information we collect when you connect your user account to an SN Service may include: (1) your name, (2) your SN Service user identification number and/or user name, (3) locale, city, state, and country, (4) sex, (5) birth date, (6) email address, (7) profile picture or its URL, and (8) the SN Service user identification numbers for your friends that are also connected to NelsonHurst’s game(s).
Customer Service
We may collect your email address when you contact our customer service group. We may use that email address to contact you about your gaming experience with NelsonHurst games and notify you about company news and promotions.
Push Notifications
We may occasionally send you push notifications through our mobile applications to send you game updates, high scores, and other service-related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings.
Game Data Collection
Whenever you play our games, we collect anonymous data about your interactions with the game and with the other players inside the game via server log files. This information may be associated with your player ID, IP address, or device ID to provide you our Services and improve them. This data is stored within Amazon Web Services.
Cookies
A cookie is a small text file that we transfer to your computer and/or device to identify a user’s computer/device and “remember” things about your visits, such as your preferences or a user name and password. In addition, the information contained in a cookie may be linked to your personal information, such as your user ID, for purposes such as improving the quality of our Service, tailoring recommendations to your interests, and making the Service easier to use. You can disable cookies at any time, although you may not be able to access or use features of the Service.
We may feature advertisements served by third parties that deliver cookies to your computer/device so the content you access and advertisements you see can be tracked. Since the third-party advertising companies associate your computer/device with a number, they will be able to recognize your computer/device each time they send you an advertisement. Clear Gifs (Web Beacons/Web Bugs)
We employ or our third-party tracking utility partner employs a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our Site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages or emails and are about the size of the period at the end of this sentence. We may associate this information with your IP address or device identifier but do not tie the information gathered by clear gifs to our customers’ personal information.
Mobile Analytics
We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personal information you submit within the mobile application.
Third-Party Services
Our services may contain third-party tracking tools from our service providers, examples of which include Google Analytics, Flurry, and HasOffers. Such third parties may use cookies, APIs, and SDKs in our services to enable them to collect and analyze user information on our behalf. The third parties may have access to information such as your device identifier, MAC address, IMEI, locale (specific location where a given language is spoken), geo-location information, and IP address for the purpose of providing their services under their respective privacy policies. Our privacy policy does not cover the use of tracking tools from third parties. We do not have access or control over these third parties.
Ad Networks
We may feature advertising within our Service. The advertisers may collect and use information about you, such as your Service session activity, device identifier, MAC address, IMEI, geo-location information, and IP address. They may use this information to provide advertisements of interest to you.
In addition, you may see our games advertised on other services. After clicking on one of these advertisements and installing our game, you will become a user of our Service. In order to verify the installs, a device identifier may be shared with the advertiser.

NelsonHurst takes reasonable measures to protect your information from unauthorized access or against loss, misuse, or alteration by third parties.

Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining access to this information. We do not warrant or represent that your information will be protected against, loss, misuse, or alteration by third parties. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
